TERMS AND CONDITIONS OF SALE AND SERVICE

Playita Mia (playitamia.com) Effective Date: November 30, 2025

By booking and paying for any tour, service, or activity through Playita Mia, you (the “Client” or “Guest”) agree to and undertake to comply with the following Terms and Conditions of Sale and Service.

1. Booking and Payment Process

  • Acceptance: All bookings are subject to confirmation of availability by Playita Mia and the tour provider (the initial booking status is PENDING).
  • Contract Completion: The service contract is considered formally established once the booking status changes to APPROVED and the official ticket is sent to the Client.
  • Payment Method: Payments are processed securely through the Stripe payment gateway. Playita Mia does not store credit or debit card data on its servers.

2. Cancellation, Deposit, and Refund Policies

Playita Mia’s policy regarding payments made (deposits or full payments) is established as follows:

A. Nature of Deposits and Payments As a general rule, payments made to secure any booking are non-refundable.

B. Cancellation by the Client If the Client wishes to cancel the service:

  • The cancellation must be formally requested in writing to Playita Mia’s official email at least 48 hours in advance of the tour’s start date and time.
  • In the event of a cancellation with the required notice (48 hours), the refund will be processed minus the operating costs and Stripe payment gateway commissions incurred in the original transaction. These charges are non-recoverable by Playita Mia.

C. Cancellation by the Provider (Guaranteed Refund) A full refund only applies if the cancellation is attributable to the service provider or Playita Mia. This includes, but is not limited to:

  • Cancellation of the tour due to poor weather conditions that prevent safe operation.
  • Internal logistical issues or last-minute unavailability on the part of the operator.
  • In these cases, Playita Mia will process a full refund or offer an alternative date or a tour of equal value.

D. Cases where NO Refund applies A refund does not apply under any circumstances if the loss of service is attributable to the Client:

  • No Show: If the Client does not show up at the pickup point or tour location at the agreed time.
  • Late Arrival: If the Client arrives late, causing them to miss the tour departure.
  • Refusal due to Physical Conditions: If the operator rejects the Client for failing to meet the health or age restrictions of the tour (e.g., pregnancy, heart problems, young children).

3. Guest Responsibility, Safety, and Risk

The Client has the following responsibilities and accepts the following conditions related to the safety and logistics of the tour:

  • Acceptance of Risk: The Client acknowledges and accepts that tourist and water activities involve inherent risks. The Client assumes full responsibility for any accident, injury, loss, or personal or material damage that may occur during the tour.
  • Conduct and Compliance: The Client agrees to strictly follow all instructions and safety rules provided by the tour guides and operators. Failure to follow these instructions may result in exclusion from the tour without the right to a refund.
  • Pickup Point: Be ready at the pickup point (hotel or provided address) 15 minutes before the confirmed start time.
  • Contact Information: Provide truthful and operational contact information (email and phone) to receive notifications and be contacted for logistics.

4. Liability and Scope of Playita Mia (Intermediary)

Playita Mia operates exclusively as a booking intermediary agent between the Client and the final tour provider (operator).

  • Exemption of Liability for Accidents: Playita Mia is not responsible for injuries, accidents, property damage, delays, inconveniences, losses, or any other adverse circumstances that may occur during the tour or activity. Legal and operational responsibility rests entirely with the final operating company, and ultimately, the risk is assumed by the Guest.
  • Limited Function: Our responsibility is limited to ensuring the correct booking, payment processing, and the accurate transmission of information between the Client and the Operator.

5. Exclusions and Additional Charges Not Included

The booking price only covers the services specifically detailed in the tour description. The following items are considered exclusions and may incur an additional cost to be paid directly by the Client on-site:

  • Gratuities (Tips): Tips for guides, drivers, and tour staff are not included in the booking price and are at the Guest’s discretion.
  • Rentals and Additional Equipment: Some tours or activities may require the mandatory rental of safety or complementary equipment that is not covered by the tour cost. Examples include: Life jacket rentals at certain cenotes, pier taxes (dock fees), or local environmental taxes.
  • Personal Expenses: Alcoholic beverages, snacks, souvenirs, photographs, or any other expense not explicitly mentioned as included.
